How do public tenders work in the United States?
A US federal public tender is a solicitation. A contracting officer, acting for a federal agency, describes the supplies, services, or construction, states how offers will be evaluated, and awards a contract under the Federal Acquisition Regulation (FAR) and any agency supplement. Above the simplified acquisition threshold, the two fully competitive methods are sealed bidding and negotiated procurement. Sealed bidding uses an invitation for bids. Negotiated procurement uses a request for proposals.
State, city, school, and public-university purchases are not federal solicitations. They follow state law and the buyer’s own portal. SAM.gov is the official system for federal opportunities. It is not a complete journal of every public tender in the United States.
Where are US federal public tenders published?
Contract Opportunities on SAM.gov are the public notices of federal solicitations, amendments, and awards. The solicitation, including the statement of work and the clauses, is attached or linked from that notice. The title of the notice is not the specification.
Agencies also post on their own pages. When you are preparing an offer, download every amendment from the SAM.gov notice before you submit. public tenders and tender opportunities explains why a notice and a tender pack are different documents. State and local tenders need a separate search on that government’s own site.
Which thresholds and procedures apply to US federal tenders?
FAR 2.101 defines the thresholds that changed on 1 October 2025. The micro-purchase threshold is $15,000. It is $2,000 for construction subject to wage-rate requirements and $2,500 for services subject to the Service Contract Labor Standards. The simplified acquisition threshold is $350,000. Acquisition.gov’s threshold-change table lists those amounts and the contingency exceptions.
At or below the micro-purchase threshold, agencies may buy with methods that often do not produce a public solicitation. Between the micro-purchase threshold and the simplified acquisition threshold, simplified acquisition procedures apply. Above the simplified acquisition threshold, full and open competition is the rule unless an exception in FAR Part 6 applies.
Trade-agreements thresholds decide when the Buy American statute is waived for eligible products. For 2026 and 2027, the US Trade Representative set the WTO Government Procurement Agreement thresholds for listed central-government entities at $174,000 for goods and services and $6,683,000 for construction. Sub-central entities are $474,000 for goods and services, and other entities are $535,000, with construction at $6,683,000. The FAR was aligned to those figures in the rule published on 13 March 2026. A solicitation states whether trade agreements apply. Do not assume every federal buy above $174,000 is open to every foreign product.
What documents and deadlines do US federal tenders use?
A solicitation package typically includes the uniform contract format or a commercial-items format, a statement of work or specification, evaluation factors, representations and certifications, and clauses incorporated by reference. Offerors complete those representations in SAM. Amendments are numbered. The proposal or bid is late if it arrives after the time stated in the solicitation, subject only to the narrow late-offer rules in the FAR.
FAR 4.1102 requires offerors and quoters to be registered in SAM at the time they submit an offer or quotation, so they can complete annual representations and certifications. The section lists exceptions, including some card micro-purchases, classified contracts, and certain urgent or overseas awards. For a routine federal competition, plan on an active SAM registration and a Unique Entity ID before the deadline. Registration is not instant.
What language are US federal tender documents in?
English. Solicitations, clauses, and amendments on SAM.gov are in English.
Submit the offer in English unless the solicitation expressly allows another language. A translation that is not in the file is not part of the offer.
What should a foreign bidder check in the United States?
Confirm three things before writing. The notice is a federal solicitation, not a state or city one. Trade agreements, or another exception in the solicitation, actually let your product or service compete. No security, export-control, or domestic-source restriction removes it. Then start SAM registration early enough to be active when the offer is due. FAR 4.1103 tells the contracting officer to identify the contractor from the legal business name and address on that registration.
A company that only watches SAM.gov will miss state and local work. TenderFaro does not claim to search those state portals. how to find public tenders worth opening is the general note on using the official source for the market you can actually serve.
How does TenderFaro help with public tenders in the United States?
SAM.gov search in TenderFaro is available when a server credential is configured. Until that credential is present, the product says the source needs configuration rather than returning invented federal notices. TED and UK Find a Tender remain the sources discovery searches without that credential. Neither is a substitute for a SAM.gov solicitation.
TenderFaro does not award contracts and does not decide legal eligibility. Discovery searches published notices on TED and UK Find a Tender. SAM.gov search is available when a server credential is configured, and the product says so rather than inventing results. Importing a notice stores it for your organisation and does not start an analysis. With the tender documents in hand, TenderFaro helps a team turn them into structured requirements and compare those requirements with company evidence, with the source wording kept next to the finding. Gaps and potential blockers stay visible for a person to review.
A search result is not a tender pack. A watch match is not a recommendation to bid. An evidence comparison is not a compliance ruling. The company makes the decision. Nothing on this site guarantees an award. The product path is in discover tenders, how TenderFaro works, and a sample analysis.
